Lawyer, solicitor or barrister – what’s the difference ?

Some clients call us asking if they need a lawyer, solicitor or barrister for their legal issue. So, what’s the difference and which one do you need ? A lawyer is a generic term for a person who is registered to practice law. They may be a solicitor or a barrister. A solicitor is a professional who has qualified and been admitted to practise law. In the first instance, you will call a solicitor when you have a legal issue. The Law Society of NSW is the body that issues practising certificates to solicitors in Sydney, Parramatta and the Central Coast. NSW solicitors are permitted to represent a client in court. If a solicitor feels it is in the best interests of their client, they may recommend retaining a barrister. A barrister is a legal professional who has taken the NSW Bar Examination and spends most of their time in court. Barristers are retained by solicitors for specialist cases and members of the public cannot directly engage a barrister. A barrister takes instructions from the solicitor managing the case.
